At the recent Community Information session held by MCA Homeowners, independent local Land Use Attorney Susan Schoettle made a presentation evaluating the proposed Ground Lease Agreement Between the MCA and Benderson Realty Development, Inc. Susan is not a resident of The Meadows.

    This is an excellent, detailed and factual analysis by Susan Schoettle, a 35-year land use attorney, not an environmental attorney. She absolutely shreds the proposed agreement by point out the deficiencies, misrepresentations, faulty construction, and risks for the MCA. In summary, she makes Becker & Poliakoff, attorneys to the MCA board, look like they seriously dropped the ball.

    The Meadows will be losing control to make decisions on 500 acres (about 30% of total land) with the Benderson deal. We should be a 100% self governing community.

    Once the Lease is in effect and the CE Option exercised by written notice from BRD to MCA,MCA has no control or consent over the terms of the CE (which will control how the land may beused for conservation, passive recreation and restoration/creation of wetlands and habitat
