Consolidated Meadows Restrictions document

I you are interested in understanding the MCA’s restrictions, you need to review the Declaration of Maintenance Covenants and Restrictions on the Commons for The Meadows that are posted on the MCA website. Sounds simple enough, but you actually need to read the 1976 document (looks like it was typewritten, then photocopied a number of times, then scanned), AND then review the 21 amendments sequentially to know what the current restrictions are. It is extremely difficult to ascertain what the current restrictions are, and you certainly can’t use a computer’s “find” function.

We are at a loss as to how a consolidated document is not available for residents to understand (same for the Bylaws and Articles of Incorporation). This seems like really basic stuff.

At the March 2024 MCA Annual Meeting, the MCA President indicated that the MCA consolidated documents would soon be posted. That was welcome news, but we are now 9 months later and they are not posted. So we took a shot at it. We used online Optical Character Recognition (OCR) tools to covert the scans into Word documents, then used Word’s tools to help identify errors. There probably still are some inaccuracies but we believe it is representative.

There is a gap in 16. COLLECTION OF ANNUAL MAINTENANCE ASSESSMENT. The original document has sections (a) – (d). The Nov 12 1996 amendment adds section (g). There is no amendment provided for sections (e) and (f). If anyone can get them from the MCA we’d happily add them to the document.

The big takeaway from reviewing this, the Articles of Incorporation and the Bylaws: The MCA Board can change anything at anytime with a majority vote.

There are only 2 things that MCA Homeowners get to vote on:
1. Elect directors.
2. Any changes that affect MCA Homeowners’ voting rights.
THAT IS IT.
