Time to get the TMCC 2023 Form 990!

As we’ve previously revealed, TMCC is legally obligated to provide its Form 990 for up to the last 3 years to the PUBLIC. Link to IRS’s FAQ on this.

Their deadline for filing the 2023 Form 990 with the IRS is May 15 2024. That was of course, yesterday so their 2023 Form 990 is required to be available TODAY!

So it is time for some MCA Homeowner action! Head on over to the TMCC offices and request a copy of TMCC’s 2023 Form 990. They can require a “reasonable” fee for making copies, but they MUST provide copies to you to take with you. None of this “you can view but can’t copy” nonsense. IRS defines a reasonable fee as $1 for the first page and 20 cents per copy after that, so it will likely be $7-8. It would be a lot easier on TMCC if they just emailed you a PDF, but it wouldn’t be the first time they choose the difficult route.

What if TMCC doesn’t comply?

Section 29(F) of the lease of the assets between MCA and TMCC requires:  “The Club shall comply with all applicable federal or state laws and the MCA declarations and restrictive covenants.” Because the MCA requires that TMCC complies laws under the terms of the lease, the MCA is obligated to enforce the terms of the lease. The lease shouldn’t even matter since the law is the law. But it does mean it is appropriate to contact the MCA GM (francesrippcondi@meadowsca.com) and MCA President to compel TMCC to abide by the lease terms if TMCC doesn’t provide the 2023 Form 990.

To recap:

TMCC is required to provide copies IMMEDIATELY for in-person requests.

They must be provided to the public, so your identity or Meadows residency or any other identifying information are not required or appropriate to request.

Requests need to be made to TMCC office at the north end of the main clubhouse building. MCA does not have this information (they basically avoid getting it) so don’t request it from the MCA.

However, if TMCC does not comply, MCA is responsible under the terms of the lease to compel TMCC to comply. So that is the time to go to the MCA offices and request that they straighten out TMCC.
