On Monday we made an important shift from providing information, to taking legal action for the community.
Based on the information accumulated on this website, and especially as expressed in the last two posts on the board’s legal duties, our lawyer has prepared a demand letter. It was sent on Monday and the MCA received it today.
The demand letter is focused on two issues as they are the most comprehensive and urgent issues. In brief, it lists the boards failures to meet its legal duties to MCA Homeowners and articulates our demands on two issues:
- We want a better economic deal for use of MCA Homeowners’ assets, whether it is with TMCC, MCA operating the assets directly, or a third party, and we want independent expert advice on how to achieve that.
- The independent negotiation of a lease renewal with TMCC that rectifies the many governance failures in the past leases, and limits its length to 1-year, so that any findings from the first point can be promptly implemented.

(You may note that the demands are expressed by a single MCA Homeowner. This is necessary for legal purposes, but it expresses the views and efforts of all of us)
This is an important step to addressing these two issues, but
the board needs to know that it reflects YOUR views too.
So, we have a very important ask from you: Let the board know that you support the “Diaz Demand Letter” by emailing the MCA GM at francesrippcondi@meadowsca.com, and copying us at ForTheMeadows@SarasotaMeadows.com. Or send your support in writing to the MCA GM via mail or dropping off your comments at the Meadows Community Center office. Please ensure your emails include your MCA Homeowner name and Meadows address. Keep it clear, concise and respectful.
This is a really important part of the efforts to bring about meaningful change in the governance of the community. So please do your part and ask all your fellow MCA Homeowners to do so as well.
